REGINA – One Regina man will have some more time in jail to think about his penchant for carrying knives.
Daniel Charles Cyr, 30, appeared in Regina Provincial Court on Aug. 29, via video from the Regina Provincial Correctional Centre. He entered guilty pleas to charges of possessing a knife for a dangerous purpose, theft under $5,000, assault with a weapon causing bodily harm, failure to attend court, and failure to abide by a probation order. The Crown stayed two other counts.
For the charge of possessing the knife, Court heard that on Aug. 8, police received a complaint of a man approached by three other men. One in the group pulled a knife, but did not steal or cause injury to the complainant. Police found the men - one of whom was Cyr - and discovered a large knife on his person. Cyr also told police he had multiple knives in the backpack he was carrying.
During another incident on Aug. 14, police were called to a Superstore location in Regina after a shoplifter allegedly threatened a loss prevention officer with a knife. Police later found their suspect - matching the description provided by the LPO - riding a bike. The suspect was identified by police as Cyr and all items stolen were recovered. At the time of the incident, Cyr was under conditions not to possess a knife.
In a joint submission from the Crown and Legal Aid, a further period of incarceration giving credit for time served followed by probation was proposed. Judge James Rybchuk accepted what the lawyers had to offer, advising Cyr that crime involving knives is “something we’re just not going to tolerate in this community.” He added that the global sentence is something that makes sense in these circumstances, being a “step up” in the level of seriousness regarding the matter, but also holds a rehabilitative component.
For the assault with a weapon charge, Judge Rybchuk sentenced Cyr to 180 days behind bars. Given credit for Cyr’s 16 days already spent in jail (translating to 24 days with enhanced credit), that amounts to 156 days going forward. Cyr also received 30 days concurrent for each of the shoplifting and breach of probation charges. Cyr was further sentenced to 60 days consecutive for possessing a knife with a dangerous purpose, and 30 days concurrent for the breach of undertaking.
Once Cyr is released, he will be under a 12-month probation order including conditions of no contact with a named complainant, not to attend the Superstore location where the incident occurred, attend substance abuse programming and not to possess weapons.
As per defence counsel request, the victim fine surcharge was waived.
