Courthouse continues to deal with kidnapping accused

Two men charged after alleged involvement in a kidnapping on May 22, made appearances in Estevan provincial court on June 9.

Two men charged after alleged involvement in a kidnapping on May 22, made appearances in Estevan provincial court on June 9.

Both were scheduled to have show-cause hearings, but Ronald Himmelspeck and Creston Hansen, were remanded in custody as those hearings were rescheduled to July 4. Two other co-accused, Dustin MacNeil and Spencer Persson, made appearances in court on June 13 and both matters were adjourned until July 4 as well.

Another co-accused, stemming from the same incident, Amanda Knebush, was in court on Monday for the results of a bail verification report that was ordered during her last appearance. The report, however, was not completed and she was remanded in custody until her next appearance on June 23.

In other court proceedings, Murray Bruce Ross, a 61-year-old man from Antler, Saskatchewan, had a bail hearing before Judge Karl Bazin. Ross has been charged with unlawfully possessing a firearm, uttering threats and being in breach of a court order.

Bazin ordered a bail verification report and that the matter come back to Carlyle provincial court today. The report is meant to assist the court in determining whether an accused person might be released or remain in custody, and if a release is suggested, the report will recommend any conditions, pending court approval.

Estevan native, Justin Garrow, also made an appearance in court last Thursday. Garrow, who remains in custody, entered not guilty pleas to charges that include breaking and entering, uttering threats and breaching a probation order. A trial was scheduled for Aug. 30. He was represented by Estevan's Legal Aid counsel Robert Grimsrud, who was looking to schedule the trial in July. The court pointed out that the trial could be bumped up to some time in July if scheduling worked out.

In other court proceedings, Bernard Sterling appeared before the court on June 13. Sterling, who is awaiting trial for charges that allege child pornography possession, no longer qualifies for Legal Aid. He appealed that decision but lost. He is now exploring the possibility of court-appointed counsel and will be back in court July 4 where he will make the application to the court.

Kevin Kenneth Dexter, who is facing charges of drug trafficking and possessing property obtained through crime, has set dates for a preliminary inquiry to be held on Dec. 1 and 2. The charges date back to October 2009, and he has already elected a Queen's Bench trial by judge and jury.

Estevan resident Justin Yakimchuk pleaded guilty to theft and breaching a court order after failing to complete 80 hours of community service. Yakimchuk was in custody on Monday but the Crown prosecutor agreed to his release under some conditions. His next court appearance is June 27.
