A 32-year-old Weyburn man, Andrew Harper, has pleaded not guilty to a charge of aggravated assault, and will remain in custody until Tuesday, Nov. 1, to set a date for a preliminary hearing.
Harper appeared in Weyburn provincial court on Oct. 18 and elected to be tried by a judge and jury in Court of Queen's Bench; prior to a trial date being set, he will have a preliminary hearing in provincial court to determine if there is enough evidence to send the matter to trial.
He has been in custody since he was arrested on Oct. 1, when he was charged with wounding or endangering the life of a three-year-old boy by assaulting him.
The boy was taken to Weyburn General Hospital, and due to the severity of his injuries was rushed to the Regina General Hospital, where he underwent emergency surgery. Police later characterized the injuries as blunt force trauma to the head.
Police also indicated that Harper was known to the victim and the family, and the assault happened in the victim's home.
