City breached privacy act

Officials with the North Battleford Parks and Recreation Department are red-faced after they unintentionally breached the Freedom of Information and Protection of Privacy Act.

The breach came about when the Kinsmen Aquatic Centre sent out a poster to individuals' mailing addresses inviting them to consider the Aquatic Centre as a birthday party location in December, using their registration software to sort individuals who were born in that particular month.

According to a Dec. 8 memo to council from Bill Samborski, general manager of facilities, this turned out to be a violation of the act - sending information without consent.

According to Samborski, that a recipient of the advertising made a complaint to the Ministry of Municipal Affairs.

Municipal affairs then contacted Robin Langille Nov. 29, and informed him they cannot send out invitations for birthday parties or special events that are derived from registration forms unless consent is given by participants or parents.

Samborski informed council his department has stopped all advertising mail outs and further investigation will be made through the Compliance Office to ensure they are in compliance before proceeding with any future mail outs. Changes to the registration form are being investigated so they are in compliance with this legislation.
