Then Judge Marshall Ferguson in Seattle issued a permanent injunction barring the merger in Washington after concluding it would lessen competition in the state and violate Washington鈥檚 consumer-protection laws.

On Wednesday Albertsons said that Kroger failed to exercise 鈥渂est efforts鈥 and to take 鈥渁ny and all actions鈥 to secure regulatory approval of the companies鈥 agreed merger transaction.
